Confirmed Session Fee

The amount agreed upon with the photographer when booking the event that was finalized between both parties. Due on the date of the event, at the end of the session. To be fully paid in cash OR via e-transfer sent to baljitksp@gmail.com. *This does not include any overtime fee that may be applicable*

Terms & Conditions

1. DEFINITIONS. (a) For the purpose of this agreement “the Agency” and “the Client” shall where the context so admits include their respective assignees, sub-licensees and successor in title. In cases where the Photographer’s Client is a direct Client (i.e. with no Agency or intermediary), all references in this agreement to both “the Agency “ and “the Client” shall be interpreted as references to the Photographer’s Client. (b) For the purpose of this agreement “The Photographer” will mean the Author of the Photograph or Baljit Singh, and shall where the context so admits include their respective assignees, sub-licensees and successor in title. (c) “Photographs” and “Works” means all photographic material furnished by the Photographer, whether transparencies, negatives, prints, digital files or any other type of physical or electronic material in existence now or yet to be developed. (d) All contracts verbal or written are only accepted on the basis that the Terms and Conditions of the Photographer are the only ones applicable. (e) Other Terms and Conditions proffered by the Client are specifically excluded unless agreed in writing beforehand by the Photographer. (f) Where time is of the essence the Photographer entirely at its own discretion may accept an instruction given orally, in this event the Photographer shall accept no liability for any error in executing the order. (g) Unless the Photographer is given prior written notice by the Client, the person placing or signing the order on behalf of the Client is deemed to be authorized to do so. 2. COPYRIGHT. (a) The Photographer retains the entire copyright at all times throughout the world for the photographs taken during the specified session. Where a digital file of photographs has been provided to the Client as a part of their personal collection, these photographs may be printed and displayed at home and on-line, for personal but not commercial use. The Photographer retains the right in all cases to use the photographs obtained under this agreement in any manner at any time in any part of the world for the purpose of advertising or otherwise and maintains ownership of the original digital file. 3. CLIENT CONFIDENTIALITY. (a) The Photographer will keep confidential and will not disclose to any third parties or make use of information communicated to her in confidence for the purposes of the photography, save as may be reasonably necessary to enable the Photographer to carry out her obligations in relation to the commission. 4. PAYMENT. (a) Payment by the Client will be paid on the day of the event, after the event in cash or e-transfer to the photographer. Their will be a charge of $175 per hour for any overtime hours required after the 3 hour mark. 5. CANCELLATION & POSTPONEMENT. (a) A booking is considered firm as from the date of confirmation and accordingly the Photographer will, at her discretion, charge a fee of cancellation or postponement. Cancellation fees are based on type of event and will be stated to the client before booking. 6. MODEL RELEASE: (a) The Client hereby assigns the Photographer the irrevocable and unrestricted right to use and publish photographs of the attendees and the Client, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The Client (includes; also on the behalf of attendees) releases all claim to profits that may arise from use of images. 7. CAPTURE AND DELIVERY: (a) The Photographer is not liable to deliver every image taken at the event. The determination of images delivered to the Client is left to the discretion of the Photographer. All images will be returned to the Client via online file sharing platform, in two weeks starting at the day of the event and once payment has been made in full. Two batches of pictures will be provided; one low-res but sufficient for social media/online sharing use. And another high-res for personal printing use. Any other use of images is prohibited by the client unless agreed to in writing by Photographer. 8. POST PRODUCTION AND EDITING: (a) The final post production and editing styles, effects, and overall look of the images are left to the discretion of the Photographer. 9. ELECTRONIC STORAGE. (a) Digital Data is stored by the Photographer on the understanding that the Photographer is not responsible for the future integrity of that data, or of any failure to retrieve data from the Photographer’s archive. Once the client has received the images, it is solely their responsibility to store the images from there on out. 10. APPLICABLE LAW. (a) This agreement shall be governed by the Canadian Copyright Act. 11. VARIATION. (a) These Terms and Conditions shall not be varied except by agreement in writing.
